Applying For Legal Aid


Legal aid helps you out with the financial side of court proceedings should you be unable to pay for them yourself. It is possible to assess whether or not you could be eligible for legal aid online, the assessment takes into account your income, the amount of savings you have, whether you have a partner, your ages, whether you claim government benefits and whether you have any dependants (e.g. children, or you act as a carer for someone.) If you are under 18 you can claim for legal aid as well but it may be assessed on your parent's income amount. This may not apply however you are engaged in legal proceedings against your parents.

Each case is different and will be assessed on its own merits. Legal aid may be more likely to be granted depending on what kind of legal issue you are faced with. It may be awarded with the premise being that you will pay part, or all of the aid back should you win your case. You can receive different levels of aid depending on what you require ranging from legal advice up to legal representation in court.

How Do I Apply For Legal Aid?

You can get advice about legal aid for free from the Citizen's Advice Bureau. You should contact Community Legal Advice to begin your application. They are easily contactable either by telephone or by text message and a call back service is also available to save you the costs of the phone call. They will fully assess you and provide you with a personal advisor to take you through the process. The advisor will make the application for you and if you are eligible you will receive aid straight away.

What If I Can't Get Legal Aid?

Do not panic if you cannot get legal aid from the government. Depending on the type of case you are involved in you may be able to enter into a 'no win no fee' agreement with a firm. Commonly firms will offer 'no win no fee' service for unfair dismissal cases and for personal injury claims. If you or your partner is a member of a Trade Union you may be able to make a claim via them. Finally, check whether you have legal expenses insurance (LEI). Sometimes LEI is included in home insurance policies or it is possible to take out LEI as an add-on to your home insurance for a small fee.
