What happens when you are controlled by old credit card debt?

Did you receive an old credit card debt default summons? Or do you have collectors calling you every day and threatening to take legal action? For many "junk debt collectors" who have filed lawsuits against old credit card debts (which may have been charged, causing you to think that you "can't reach") has become a big business.

If you are like most American citizens who are chased by creditors, you may ignore their appeals and letters, thinking that they will always disappear. error. The new junk bond buyer will serve you with the complaint briefing!

What is a junk bond buyer?

They usually have a legal lawyer working for them, and the rest of the employees are ordinary old collection agents. All that JDB needs to do is to file a complaint (usually a breach of contract) with a civil or district court in your county. They will pay a nominal fee and a process server to send the subpena to you personally.

You can use it at your workplace or home!

You usually only need 20 days to respond to the subpoena. This is a file that must be submitted by you personally in the court, and a copy of the certification email sent back to the lawyer representing the creditor.

If you do not respond to an answer within 20 days (on the date of your service), your default judgment will be charged to you, and this will give collectors a green light, freezing your bank account and clearing Your salary!

Note: Usually "collecting lawyers" themselves are junk bond buyers and actually have debt.

Most breaches of contract lawsuits are brought in civil courts, not small claims. Creditors are smart and know that in a civil court you must be represented by a lawyer, or you can buy on your own behalf and must abide by the court's standard rules and procedures. This is called the "Pro Se" litigant.

"Pro Se" litigants must submit appropriate legal petitions and represent themselves as lawyers. This is really simple, but you can understand why this would scare off so many litigants, why the citizens judges often accept complaints and give default judgments one to two afternoons a week, because few defenders know how to/have There is no time to understand how to respond within the time frame of (20) days.

In May 2007, I was summoned for breach of contract. I immediately began research ... and research ... and research.

I am a middle-class person and I ran some debt when I was in my early twenties. I made sporadic payments without realizing the harmful effects it had on my credit report. Everyone told me that I actually charged about $1,000 on the VISA card. It was handed to various collectors, where I would make one or two big payments, and then I couldn't hear anything... All the late fees, excess fees and interest charges, I think I may have paid the money I originally owed, and at the time I could not keep up. So, I started to study. It's not easy, but it's worth it. I began to conduct research in the law library, learning legal message boards, NOLO legal books, and credit repair blogs and websites. I spoke to a very helpful court employee who told me how these companies operated and fortunately I was enough to negotiate with a consumer lawyer.

All my work was rewarded and my creditors gave up their lawsuit.

The first step is to "answer questions" regardless of your specific situation. Your creditors will either waive the lawsuit or you will be awarded a court date. It is very likely that creditors will not appear on the court date (allowing you to cancel automatically) and if they do so, you can negotiate better with them for a solution or payment plan.

Using the Internet, there are many people on the same boat as yourself. There are many useful message boards that are a good start.

Try to remember that even if the debt belongs to you, you have the right to present to you the accusation against you. These companies are making huge profits from hard-working Americans. You should be responsible for yourself and your future finances in order to face music as much as possible and fight your lawsuit.
